This course was designed to help the busy patent practitioner avoid prosecution pitfalls in light of recent Federal Circuit rulings. PRG’s Academic Director, Paul Gardner, will discuss recent case law and provide analysis as to the court’s disconcerting rationale in reaching its judgments.
Until recently, the law precluding importation of limitations from patent specifications into claims had been held inviolate.
Until recently, an inventor was permitted to claim his or her invention as broadly as the prior art and the embodiment(s) disclosed in the specification allowed.
In its decisions of late, however, the Federal Circuit has cast serious doubt on the continued viability of those basic principles, and has (1) interpreted broad claims to include limitations not recited in the claims, and therefore not infringed, or has (2) held broad claims to be invalid for lack of written description support for failing to recite an “essential element” of the invention.
This 1.5-hour Video on Demand course explores these recent, unfortunate case law developments, and – more importantly – the verbiage present in and absent from the specifications and prosecution histories that led to the court’s holdings of noninfringement and invalidity. Armed with this information, patent practitioners will be able to protect their clients from the disastrous results suffered by the losing patentees in these cases.
