Here is a survey course that provides an up-to-the-minute review of decisions and trends in patent law in the courts, the agencies, and in Congress. It covers what’s pending before the Supreme Court and what’s coming up.

Where is the Federal Circuit headed and what are the cases to watch for? How are the district courts implementing recent Supreme Court and Federal Circuit decisions such as eBay, KSR, MedImmune, and Seagate? What are the trends in Hatch-Waxman litigation? Which issues will be heading to the Court of Appeals and when? What are the trial courts up to with new patent rules, jury instructions, pretrial and trial procedures? What other issues are hot at the district courts?

What is happening with Patent Reform, in Congress, and at the USPTO? Is the ITC case load continuing to increase? What types of cases are being filed and how are the judges handling them? Is the whole process pro-plaintiff? What pots are the academics stirring and will their issues pop up in patent litigation?

This course will provide a comprehensive update of recent developments in the patent laws. It will offer an across-the-board look at what is happening in the courts, at the agencies, and in Congress, and will prepare patent counsel to address issues with a current understanding of where the law is, and where it may be going. The course will also include a review of the most recent decisions on ethics issues and sanctions in patent litigation (on the second day from 10:00 to 11:00 a.m., as currently estimated).

Requirement: In order to maximize the value of the course to you, the Hot Topics faculty will provide a flash drive to attendees containing up-to-the-minute supplemental cases that will be discussed in class. Due to the voluminous nature of the supplemental cases, it is not feasible to provide this material in paper format. For this reason, it is necessary that you bring your laptop with you to the course.
